Post Appeal to return two children to the US rejected
Story
Quote:
TWO BOYS, now aged nine years and seven, who were wrongfully removed from New York to Ireland by their mother, should not be returned to their father in New York because they expressed a clear desire to remain with their mother and it is in their best interests to stay in Ireland, the Supreme Court has ruled.

What are your thoughts on this? Both this specific case and how nations law systems interact with each other, or how they should interact with each other.
I found this particular story interesting as I had only been reading about a proposal in America to enforce their drug laws, globally (Story), I think this shows how farcical such an idea is, when such a (less face it) globally insignificant country like Ireland can just turn around and say "No".

Normally I would be opposed to any parent absconding with the children to a foreign country (which is often done to punish a spouse). But after reading about this case from the link you gave, Milky, I think I have to agree with Chief Justice Susan Denham that this was one of those “exceptional” cases. Even here in the U.S., the father was shown to have been abusive, not to mention the fact that he had run away to Nigeria at one point in order to avoid facing prosecution for having assaulted a police officer. I think that woman may have been lucky that her ex didn't take the kids against their will to Nigeria. Cheers to Ireland for putting a stop to the madness!

As for the U.S. butting into a sovereign nation's business in order to enforce our own crazy War on Drugs... The U.S. government doesn't "own" its citizens like slaves. If another nation is cool with what a U.S. citizen does within that nation's sovereign boundaries, then I don't think our government has any business poking its intrusive nose in there.

After all, when a person from a foreign regime comes to the U.S. to escape oppressive laws in his/her home country, we don't allow the foreign nation to interfere any longer in that person's life once that person is on U.S. soil, provided that person isn't breaking any of our own laws.

It's nice to see that we have judges who can occasionally make a sensible call.

I just checked GovTrack.US for the current states of this bill (sponsored by Republican Representative Lamar Smith of Texas), and it doesn't seem as if much is happening with it right now. Also, 88% of the American public expressing their views on this bill (at PopVox.com) are opposed to it.

I have to agree with you, Nephele... and had I been the mother I would have the very same thing.

I cannot add anything to this since you already stated my opinions so well.
